TEREMS AND CONDITIONS

Definintions of TERMS.

  • “General Conditions” Those item(s) that do not form part of the actual product once the project is finalized such as plans, permits, utilities, office trailers, clean up, mobilization and demobilization for example.

 

  • “Construction Documents” Those documents forming the basis for the project such as, plans, specifications, shop drawings, renderings, digital media, and written scope of work.

 

  • “Scope of Work” Is represented in the Construction Documents including the Contract, Plans, Specifications, Change Orders, and any other forms of written communication that is mutually agreed upon.

 

  • “Time of Completion” Is calculated from the time of mobilization to Substantial Completion.

 

  • “Substantial Completion” Substantial Completion is the point at which the scope of Contract work is sufficiently complete in accordance with the Contract Documents. This is the point in which the owner can move in, take possession and or use project for its intended use.

 

 

  • “Progress Payments” Payments made after the initial deposit and non-refundable’s. These payments are based on progress (or percentage complete) of the project at time of billing.

 

  • “Change Order” A written document that modifies the plans, specifications and or the price of the construction Contract. Change Orders are not considered part of the Contract and therefore not subject to “Substantial Completion”.

 

  • “Pre-existing conditions” Any conditions not readily seen or discussed during the budgeting process. This includes but not limited to; Structural, Mechanical, Electrical, Thermal, Drainage and Roofing.

  • Contract Documents
    • The contract documents consist of this agreement, general conditions, construction documents, specifications, allowances, finish schedules, construction draw schedule, information disclosure statement, all addenda issued prior to execution of this agreement and all change orders or modifications issued and agreed to by both parties. All documents noted herein shall be provided to the Contractor by the Owner.  These contract documents represent the entire agreement of both parties and supersede any prior oral or written agreement.
